We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.

12. Online payments

Please read these terms carefully before using the online payment facility. Using the online payment facility on this website indicates that you accept these terms. If you do not accept these terms do not use this facility. All payments are subject to the following conditions:-

  • your payment will normally reach DPEL Ltd’s account within 3 working days
  • we cannot accept liability for a payment not reaching the correct DPEL Ltd account due to you quoting an incorrect account number or incorrect personal details
  • neither can we accept liability if payment is refused or declined by the credit/debit card supplier for any reason
  • if the card supplier declines payment, DPEL Ltd is under no obligation to bring this fact to your attention. You should check with your bank/credit/debit card supplier that payment has been deducted from your account
  • We do not store your credit card or debit card details. Once you have completed this transaction we do not keep your credit or debit details nor do we in anyway share customer details with any 3rd parties.
  • in no event will DPEL Ltd be liable for any damages whatsoever arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages

Security – All payment details which are entered through this and/or DPEL Ltd payment gateway are encrypted when the consumer, or third party making payment, enters them. Communications to and from the service provider’s site are encrypted. DPEL Ltd shall not be liable for any failure by the consumer or third party making payment of fees to properly protect data from being seen on their screen by other persons or otherwise obtained by such persons, during the online payment process or in respect of any omission to provide accurate information in the course of the online payment process.

Data protection – In this clause the term ‘personal data’ is as defined in the Data Protection Act 1998 (‘DPA’). DPEL Ltd does not store any financial data for it’s customers (credit/debit card numbers). DPEL Ltd will not be responsible for any losses suffered by the consumer, or third party making payment, as a result of inaccurate information being provided to DPEL Ltd. Should you require any further details at all in relation to any part of the online payment process, please contact a member of the DPEL’ Team.

Refunds – The Client is permitted to adhere to DPEL Ltd’s and PayPal’s policies where applicable. If the Client is unhappy with a product, or the service provided, then the Client should contact DPEL Ltd with the complaint within 45 days. DPEL Ltd will manage the complaint on an individual basis that will not affect the Client’s statutory rights. DPEL Ltd will determine and authorise refunds on this basis and any refund issued will be returned to the Client in a timely manner. The refund mechanism will be discussed and agreed between the Client and DPEL Ltd but generally the refund will reach the Client via the mechanism the Client used initially.

In the event of such a refund DPEL Ltd’s liability will only extend to a part or total refund of all monies paid for it’s services. DPEL Ltd will not be liable for any claims for consequential loses howsoever caused. 13. DPEL Ltd right to authorship credit

Artist may use Work in Artist’s portfolio (including, but not limited to, any website that displays Artist’s works). Commissioner and Artist agree that when asked, Commissioner must properly identify Artist as the creator of Work. Commissioner does not have a proactive duty to display Artist’s name together with Work, but Commissioner may not seek to mislead others that Work was created by anyone other than Artist.

14. Designer tools

The Designer may incorporate certain Designer Tools into the Deliverables. “Designer Tools” means all design tools developed or utilized by Designer in performing the Services, including without limitation: pre-existing and newly developed software, Web authoring tools, type fonts, and application tools. In the event Designer Tools are incorporated into any Final Deliverable, then Designer grants Client a royalty-free, perpetual, worldwide, non-exclusive license to use the Designer Tools to the extent necessary to use the Final Deliverables. Designer retains all other rights in the Designer Tools.

15. Miscellaneous provisions

Any waiver of any provision of these terms and conditions must be in writing and signed by, or authorised by, DPEL Ltd to be valid. A waiver of any provision hereunder shall not operate as a waiver of any other provision, or a continuing waiver of the same provision in the future. If any court of competent jurisdiction finds any provision of these terms and conditions to be void or unenforceable for any reason, then such provision shall be ineffective to the extent of the court’s finding without affecting the validity and enforceability of any remaining provisions. For those who are not members of DPEL Ltd, these terms and conditions represent the entire understanding and agreement between you and DPEL Ltd relating to use of this website, and supersede any and all prior statements, understandings or agreements whether oral or written.
